User Agreement Last updated: 10 rd October 2017
(i) This User Agreement (“Agreement”) is a contract between you and Micro Startup Incorporated (LoadDebitCard.comR) that applies to your use of LoadDebitCard.comR products and cloud based processing Platform (the “Platform”). Except as set forth below, “LoadDebitCard.comR” shall mean LoadDebitCard.com, a Seychelles Company.
(ii) All activities relating to cryptocurrency (including holding cryptocurrency and processing cryptocurrency related transactions) shall be conducted by LoadDebitCard.comR and third parties selected by and qualified to provide services to the Platform.
By registering an account with LoadDebitCard.com. or using any of the Platforms, you agree that you have read, understood and accept all of the terms and conditions contained in this Agreement as well as our Privacy Policy, which is incorporated into this Agreement which may be changed from time to time. The text in the boxes throughout this Agreement are there to help you understand the Agreement, but is not part of the Agreement..
Who is Eligible
In order to have an account to load value to a Network Branded PC or account that you own, you must be at least 18 years of age. LoadDebitCard.comR does support business accounts. Use of the Platforms may have further eligibility or identity confirmation requirements that will need to be verified prior to you using such Platform, or from time to time, in order to continue your use of the Platform. If you want to have a LoadDebitCard.comR account, these are the rules that you are required to follow. The ability to hold your account balance in fiat currencies such as USD is not available. We will hold balances in the LoadDebitCard.comR wallet designated for this purpose in cryptocurrency. We will not open an account, or allow use of the Platform for restricted countries Afghanistan, Belarus, Central African Republic, Cuba, Cyprus, Eritrea, Fiji, Iran, Iraq, Cote d'Ivoire, Lebanon, Libya, North Korea, Syria, Vietnam, Myanmar, China, Haiti, Liberia, Rwanda, Somalia, Sri Lanka, Republic of the Sudan (Northern Sudan), Yemen, Zimbabwe, Venezuela, Democratic Republic of the Congo. All loading transactions will be in the base currency of your PC or account you provided for the deposit of funds, as part of your Transfer.
Our Registration Process
You may register for one account linked PC or account, denominated in your cards base currency and/or one account denominated in cryptocurrency, for a maximum of two accounts. If you open additional accounts, we reserve the right to immediately close such additional accounts. When registering for your account, you must provide current, complete, and accurate information for all required elements on the registration page. If any of this information changes, it is your obligation to update such information as soon as possible. From time to time we may also require you to provide further information as a condition for continued use of the Platform, including but not limited to a copy of your government issued ID, and a utility bill showing your name and address, no older than three months from submission. In order for you to load value to a PC or account, you authorise LoadDebitCard.comR, directly or through third parties, to make any inquiries we deem necessary to validate your identity and account information. This may include requesting further information about you such as your date of birth, email address, physical address, and Payment Card information. We reserve the right to maintain your account registration information after you close your account for business and regulatory compliance purposes.
Your Privacy
In order to prevent fraud, and to comply with all applicable regulations and laws, and to deposit value to a PC or account, we need to make sure that you are who you say you are. We are committed to protecting your personal information and helping you understand exactly how your personal information is being used. You should carefully read our Privacy Policy, as it provides details on how your personal information is collected, stored, protected, and used.
How We Communicate
By entering into this Agreement, you agree to receive electronic communications and notifications via text, and/or email in accordance with our policies.
Security of User Information
You are responsible for maintaining the confidentiality and security of any and all account names, user IDs, passwords, personal identification numbers (PINs) and mobile unlock codes that you use to access the Platform. You are responsible for keeping your email address up to date in your LoadDebitCard.comR account profile and for maintaining the confidentiality of your user information. You agree to
Enable all relevant security features such as two-factor authentication, and or PIN Code to protect your account. LoadDebitCard.comR will not be liable for any loss or damage arising from your failure to protect your account information. We shall not bear any liability for any damage or interruptions caused by any computer viruses, spyware, or other malware that may affect your computer or other equipment, or any phishing, spoofing, or other attack. We advise the regular use of a reliable virus and malware screening and prevention software, and change your passwords frequently.
If you question the authenticity of a communication purporting to be from LoadDebitCard.comR, you should log in to your account through the LoadDebitCard.comR website or mobile applications, Never access your account by clicking links contained in emails. Printing and mailing correspondence, disclosures, and account statements takes time and money, so we like to handle these matters electronically. We go to great lengths to protect your account, but we need you to do the same. It is important that you always protect not only your LoadDebitCard.comR password but also the email account associated with your account. Account security should be a high priority for you at all times.
Account Suspension & Closure
We may, in our sole and absolute discretion, without liability to you or any third party, refuse to let you open an account, suspend your account, or terminate your account or your use of the Platform. Such actions may be taken as a result of account inactivity, failure to respond to customer support requests, failure to positively identify you or your violation of the terms of this Agreement. If you have a balance remaining in an account, which has been suspended or closed, you will be able to recover such funds, unless prohibited by law or a Court Summons.
LoadDebitCard.comR, in its discretion, will allow you to either
Direct the loading of such funds to a directed PC or account. We reserve the right to require you to provide further identifying information before processing such withdrawal or transfer and to delay or prohibit such withdrawal or transfer if we believe fraudulent or illegal activity has occurred. You may terminate this Agreement at any time by closing your account and discontinuing use of the Platform. Upon termination of this Agreement and your account, you remain liable for all transactions made while the account was open.
Platform Provided By Third Parties
LoadDebitCard.comR provides you with a secure and convenient way to establish an account for purposes of
(a) depositing cryptocurrency and loading funds to a PC or account.
(b) holding an account balance denominated in cryptocurrency,
LoadDebitCard.comR is an independent contractor for all purposes and is not your agent or trustee. LoadDebitCard.comR does not have control of, or liability for, any products on the Platform that are purchased or sold. We strongly suggest that you always protect not only your LoadDebitCard.comR password but also the email account associated with your account and any device used to access your account.
If you use LoadDebitCard.comR to commit a crime, we will close your account. If your account is closed, we may require you to complete additional identity verification and fraud prevention steps in order to access funds in that closed account. LoadDebitCard.comR is not liable for any losses or issues that may arise from such transactions, including, but not limited to, legality, quality, delivery, or satisfaction with any products purchased.
Mobile Platform
To the extent you access the Platform through a mobile device, your wireless service carrier’s standard charges, data rates, and other fees may apply. In addition, downloading, installing, or using one of the LoadDebitCard.comR mobile applications may be prohibited or restricted by your carrier, and the Platform may not work with all carriers or devices. By using the mobile Platform, you agree that we may communicate with you by SMS, MMS, text message, push notification, and/or other electronic means via your mobile device and that certain information about your usage of the Platform may be communicated to us. In the event that you change or deactivate your mobile telephone number, you agree to promptly update your account information to ensure that your messages are not sent to any person who might acquire your old number. You will receive pin code verifications upon downloading the LoadDebitCard.comR application. You hereby confirm that with respect to any mobile phone number you have provided, you own the account corresponding to that mobile phone number, or otherwise have the account holder’s permission to use the number. If you use your LoadDebitCard.comR account to send money to someone in exchange for a product or service, and you have a problem with that product or service, you will need to resolve that dispute directly with the third party. In order to maintain the security of your account, two-factor authentication is required. That means that you need to have a valid phone and update your account information if your phone number changes. By registering a mobile phone number you are agreeing to the specific terms set forth in this Section. The LoadDebitCard.comR text messaging Platform is provided for most global mobile carriers. LoadDebitCard.comR is not liable for delayed or undelivered messages by a carrier.
Our Fees or Commission
LoadDebitCard.comR does charge a fee or Commission as a percent of the value of the cryptocurrency you send to us for loading value to the Platform, including the loading of value to PC or account, or a LoadDebitCard.comR Prepaid Card. We do not charge a fee for holding, storing or receiving cryptocurrency on your behalf. You also agree to pay any other fees that are disclosed to you with respect to the Platform or that may be charged by your bank. By directing us to load funds to your PC or account, you authorize LoadDebitCard.comR to communicate with your card issuer financial institution to provide or obtain any information required by LoadDebitCard.comR in connection with your Transfer.
By providing this information, your bank is neither endorsing LoadDebitCard.comR, nor is it in any way responsible for the Platform. When you use your cryptocurrency Wallet to deposit cryptocurrency for loading funds, you are creating a Transfer, which in part is considered an electronic transfer of your cryptocurrency. You agree that such requests from your cryptocurrency Wallet constitute your authorization to LoadDebitCard.comR to receive such transfers. Once you have provided your authorization for each Transfer, you will not be able to cancel, or amend the electronic transfer. You authorize LoadDebitCard.comR to take necessary action to reverse, credit, or debit any payment in connection with any PC or account in your LoadDebitCard.comR account; you should not be charged any fees for these correction transactions or transfers.
Crypto Currency Conversion & Volatility
When you convert one currency into another currency, for example, Bitcoin to Euro’s, etc. by confirming a Transfer tied to your PC or account, such currency conversion is completed by LoadDebitCard.comR to the base currency of your PC or account. You acknowledge that the price or value of any currency may fluctuate and that the conversion rate (the “Conversion Rate”) for converting one currency into another may not be the same Conversion Rate that applies when converting back into that first currency. You will always be shown the applicable Conversion Rate for a transaction prior to consummating the transaction. You agree to deliver the agreed upon payment upon confirmation of a deposit, regardless of changes in a currency’s value. The value of currencies (especially Bitcoin) can rapidly increase or decrease at any time, so LoadDebitCard.comR cannot guarantee the value of any currency. The Platform does not involve any extension of credit to you, and no credit is extended to you in connection with your use of the Platform. In the event you are entitled to a refund or other payment by LoadDebitCard.comR, LoadDebitCard.comR shall have no liability for any losses resulting from a change in the Conversion Rate that may have occurred since the time of the original transaction. We are not responsible for any processing delays that may result in connection with any deposit, or loading transaction. The ability to convert from one currency to another is subject to applicable legal and regulatory restrictions as well as the availability of such currency provided by LoadDebitCard.comR. All funds received into your LoadDebitCard.comR account will be delivered in the currency that your PC or account is denominated in, regardless of what crypto currency the transaction is initiated in. For example, if your PC or account is denominated in Euro’s, we will automatically convert your cryptocurrency to Euro based upon the current Conversion Rate. We are not responsible for any losses that might be incurred as a result of the Conversion Rate that applies to a given transaction. The currency conversion rates provided by LoadDebitCard.comR are constantly changing. If a transaction fails and the applicable conversion rate changes before you can complete the transaction, we are not responsible for any value lost due to that conversion rate change.
Transaction Limits and Commission Schedule
LoadDebitCard.comR reserves the right to change the loading and velocity limits on your account, as we deem necessary. We may establish individual or aggregate transaction limits on the amount or number of deposits or withdrawals you make during any specified time period. When you add cryptocurrency, unless you tell us otherwise, we will hold your cryptocurrency received and await your Transfer. A “velocity limit” relates to the speed and frequency of transactions. Please see the Tier scheduled below based on your document KYC verification. You will receive a Tier 1 approval with the receipt of basic documents, the additional levels or Tiers are based on enhanced KYC being provided.
The LoadDebitCard.comR commission schedule
1. If you deposit between 0.5-10 bitcoin per deposit, your fee is 0%.
2. If you deposit between 11-30 bitcoin, per deposit, your fee is 0%.
3. If you deposit between 31-50 bitcoin, per deposit, you fee is 0%.
The LoadDebitCard.comR Tier Schedule. If you request Tier 4 certification, you may be required to provide additional KYC verification.
Tier 1: Up to 10 bitcoin per deposit, with a monthly limit of 3 Transfer’s per month.
Tier 2: Up to 20 bitcoin per deposit, with a monthly limit of 6 Transfer’s per month.
Tier 3: Up to 30 bitcoin per deposit, with a monthly limit of 12 Transfer’s per month.
Tier 4: Up to 50 bitcoin per deposit, with an monthly limit of 30 Transfer’s per month.
Our Right to Suspend or Delay Transactions
We reserve the right to change, suspend, or discontinue any aspect of the Platform at any time, including hours of operation, or availability of any feature, without notice, and without liability. We may decline to process any deposit or withdrawal without prior notice, and may limit, or suspend your use of one or more Platforms at any time, at our sole discretion. Suspension of your use of any of the Platforms will not affect your rights and obligations pursuant to this Agreement. We may, in our sole discretion, delay deposits or withdrawals if we believe the transaction is suspicious, may involve fraud or misconduct, violates applicable laws, or violates the terms of this Agreement.
Insufficient Funds
We will load value to a PC or account equal to the amount of the cryptocurrency less the commission, we receive per your Transfer. If your account has a negative balance as a result of a deposit being rejected, or reversed, LoadDebitCard.comR may deduct amounts you owe from the balance of your account, or from Bitcoin value you subsequently deposit, or receive into your account. If LoadDebitCard.comR requests that you complete a deposit in order to resolve a negative balance issue, and you fail to do so, you authorize LoadDebitCard.comR to initiate a deposit in the amount of such deficiency from your linked, PC or account . If you have more than one account, LoadDebitCard.comR may offset the negative balance in one account by using the balance in the other account you own. To secure your performance of this Agreement, you grant to LoadDebitCard.comR a lien on, and security interest in, the balances in your account. In the event that LoadDebitCard.comR is forced to engage a third party to assist with the recovery of any negative balance, overdraft or chargeback, you will be charged any fees or expenses that are incurred by LoadDebitCard.comR in connection with such recovery efforts, including, but not limited to, collection fees or convenience fees charged by third parties. You hereby explicitly agree that all communication in relation to a delinquent account will be made by electronic mail. Note that if LoadDebitCard.comR is forced to engage such third parties in connection with recovering amounts that you owe LoadDebitCard.comR, your credit may be negatively impacted.
Refunds
Once you have initiated and confirmed a Transfer, it cannot be cancelled or reversed. You should periodically review statements from your bank, which should reflect all applicable loading transactions made using that payment method. You can also always access the record of your loading transactions by logging into your LoadDebitCard.comR account.
Restricted Activities
Critical to your usage of the Platform, is that you hereby agree that you will not: violate (or assist any other party in violating) any applicable law, statute, ordinance, or regulation; intentionally try to defraud (or assist in the defrauding of) LoadDebitCard.comR or other LoadDebitCard.comR users; provide false, inaccurate, or misleading information; take any action that interferes with, intercepts, or expropriates any Platform, data, or information; partake in any transaction involving the proceeds of illegal activity; transmit or upload any virus, worm, or other malicious software or program; attempt to gain unauthorized access to other LoadDebitCard.comR accounts, the LoadDebitCard.comR website, or any related networks or Platforms; use the Platform on behalf of any third party or otherwise act as an intermediary between LoadDebitCard.comR and any third parties; collect any user information from other LoadDebitCard.comR users, including, without limitation, email addresses; defame, harass, or violate the privacy or intellectual property rights of LoadDebitCard.comR or any other LoadDebitCard.comR users; or other LoadDebitCard.comR users; or upload, display or transmit any messages, photos, videos or other media that contain illegal goods, pornographic, violent, obscene or copyrighted images or materials for use as an avatar, in connection with a payment or payment request, or otherwise.
Acquiring Cryptocurrency
You can use your LoadDebitCard.comR account to buy Cryptocurrency for sale on other registered platforms and exchanges or to sell Cryptocurrency acquired from other registered platforms and exchanges. You cannot use your LoadDebitCard.comR account to
(i) buy cryptocurrency for sale to individuals through peer-to-peer brokerage services, or unregistered exchanges (such as Local Bitcoins, Craigslist, eBay or similar websites),
(ii) sell bitcoin that you have acquired directly from individuals through peer-to-peer brokerage systems or unregistered exchanges (such as Local Bitcoins, Craigslist, eBay or similar websites), or
(iii) buy or sell bitcoin on behalf of anyone else. In the event that LoadDebitCard.comR learns that you are making any such prohibited payments, LoadDebitCard.comR may suspend or terminate your LoadDebitCard.comR Account.
Any Taxes
LoadDebitCard.comR will maintain a record of your transaction history, which you will be able to access through your LoadDebitCard.comR Account for purposes of making any tax filings or payments. It is your responsibility to determine what, if any, taxes apply to the payments you make or receive, and to collect, report, and remit the correct tax to the appropriate tax authority. LoadDebitCard.comR will not make any tax with holdings or filings on your behalf. LoadDebitCard.comR is not responsible for determining whether taxes apply or are payable as a result of your transaction, or for collecting, reporting, or remitting any taxes arising from any transaction.
Indemnification
You agree to indemnify and hold LoadDebitCard.comR, its affiliates, and service providers, and each of their officers, directors, agents, joint ventures, employees, and representatives harmless from any claim or demand (including attorneys’ fees and any losses, fines, fees or penalties imposed by any regulatory authority) arising out of your breach of this Agreement, your violation of any websites), or buy or sell bitcoin on behalf of anyone else. If you have a dispute, you release LoadDebitCard.comR (and its affiliates and service providers, and each of their officers, directors, agents, joint ventures, employees and representatives) from any and all claims, demands, and damages (actual and consequential) of every kind and nature arising out of or in any way connected with such disputes.
Limitation of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT LOADDEBITCARD.COMR AND OUR AFFILIATES AND SERVICE PROVIDERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, AGENTS, JOINT VENTURERS, EMPLOYEES, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY DAMAGES, OR DAMAGES FOR LOSS OF PROFITS INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF LOADDEBITCARD.COMR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, RESULTING FROM:
(I) THE USE OR THE INABILITY TO USE THE PLATFORM;
(II) THE COST OF PROCUREMENT OF SUBSTITUTE “Indemnify” means to compensate someone for the harm or loss they may suffer. If you breach this Agreement or violate the law and it results in LoadDebitCard.comR facing claims or expenses, you agree to cover those losses. If you have a dispute with anyone other than LoadDebitCard.comR, you release us from liability associated with that dispute. GOODS AND PLATFORM RESULTING FROM ANY GOODS, DATA, INFORMATION, OR PLATFORM PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE PLATFORM;
(III) UNAUTHORIZED ACCESS TRANSFER OR ALTERATION OF YOUR TRANSMISSIONS OR DATA ; OR
(IV) ANY OTHER MATTER RELATING TO THE PLATFORM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE LIMITATIONS SET FORTH ABOVE MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE PLATFORM OR WITH THIS AGREEMENT, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE PLATFORM AND CLOSE YOUR ACCOUNT. THE PLATFORM IS PROVIDED "AS IS" AND WITHOUT ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS, IMPLIED OR STATUTORY. LOADDEBITCARD.COMR, OUR AFFILIATES, AND OUR RESPECTIVE OFFICERS, DIRECTORS, AGENTS, JOINT VENTURERS, EMPLOYEES, AND SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
LOADDEBITCARD>COMR MAKES NO WARRANTY THAT:
(I) THE PLATFORM WILL MEET YOUR REQUIREMENTS,
(II) THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR
(III) THE QUALITY OF ANY PRODUCTS, PLATFORM, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU WILL MEET YOUR EXPECTATIONS.
LoadDebitCard.comR will make reasonable efforts to ensure that requests for electronic debits and credits involving PC’s or accounts are processed in a timely manner, but LoadDebitCard.comR makes no representations or warranties regarding the amount of time needed to complete processing because the Platform is dependent upon many factors outside of our control, such as delays in the banking system, Internet or the international mail service. We will not be liable for “exemplary damages” (often called punitive damages) or other indirect losses. So if we do something wrong that costs you Euro 200, our liability is limited to that Euro 200. We cannot guarantee that LoadDebitCard.comR is always going to meet your demands. As we grow we will likely add new Platforms, change certain features and drop old features. We hope you are always happy with LoadDebitCard.comR, but we can’t contractually guarantee you will be. We have no control (nor does anyone else), such as delays in the global banking system, Internet or international mail service. Some countries or jurisdictions do not allow the disclaimer of implied warranties, so the foregoing disclaimers may not apply to you.
Force Majeure
LoadDebitCard.comR shall have no liability for any failure or delay resulting from any condition beyond our reasonable control, including but not limited to governmental action or acts of terrorism, earthquake, fire, flood, or other acts of God, labor conditions, power failures, equipment failures, and Internet disturbances.
Arbitration for Claims by You
Except for claims for injunctive or equitable relief or claims regarding intellectual property rights (which may be brought, in an individual capacity only, and not on a class-wide or representative basis, in the courts specified without the posting of a bond), any dispute between you and LoadDebitCard.comR related in any way to, or arising in any way from, our Platform or this Agreement (“Dispute”) shall be finally settled on an individual, non-representative basis in binding arbitration in accordance with rules on which we may mutually agree; provided, however, that to the extent a Dispute is within the scope of a small claims court’s jurisdiction, either you or LoadDebitCard.comR may commence an action in Seychelles to resolve the Dispute. Any arbitration will be conducted by a single, neutral arbitrator and shall take place in Seychelles. The arbitrator may award any relief that a court of competent jurisdiction could award, including attorneys’ fees when authorized by law. The arbitral decision may be enforced in any court of competent jurisdiction in Seychelles. An arbitral decision is subject to very limited review by a court in Seychelles.
Amendments
We may amend any portion of this Agreement at any time by posting to the Platform the revised version of this Agreement with an updated revision date. The changes will become effective, and shall be deemed accepted by you, the first time you use the Platform after the initial posting of the revised User Agreement and shall apply on a going-forward basis with respect to transactions initiated after the posting date. In the event that you do not agree with any such modification, your sole and exclusive remedy is to terminate your use of the Platform and close your account. You agree that we shall not be liable to you or any third party as a result of any losses suffered by any modification or amendment of this Agreement. If the revised Agreement includes a material change we will provide you with prior notice via our website and/or email before the material change becomes effective. For this purpose a “material change” means a major change other than changes that
(i) are to your benefit,
(ii) are required to be made to comply with applicable laws and/or regulations or as otherwise required by one of our regulators,
(iii) relates to a new product or service made available to you, or
(iv) to otherwise clarify an existing term.
Assignment
You may not transfer or assign this Agreement or any rights or obligations hereunder, by operation of law or otherwise and any such attempted assignment shall be void. We reserve the right to freely assign this Agreement and the rights and obligations of this Agreement if there is a dispute; it will be solved by a single, neutral arbitrator, located in Seychelles and not in a Seychelles courtroom. As LoadDebitCard.comR grows and offers new products and Platforms, we will need to make changes to this Agreement. If we make a big change, we’ll let you know by email. You can always tell when checking the “Last Updated” date at the top of the Agreement. We may change any third party provider at any time without notice or consent. If you object to such transfer or assignment, you may stop using our Platform and terminate this Agreement.
Survival
Upon termination of your account or this Agreement for any reason, all rights and obligations of the parties that by their nature are continuing will survive such termination.
Third Party Applications
You grant express permission to a LoadDebitcard.comR third party partner to connect to your account, either through the third party's product or through LoadDebitCard.comR, you acknowledge that granting permission to a LoadDebitCard.comR third party partner to take specific actions on your behalf does not relieve you of any of your responsibilities under this Agreement. Further, you acknowledge and agree that you will not hold LoadDebitCard.comR responsible for, and will indemnify LoadDebitCard.com from, any liability arising from the actions or inactions of this third party partner in connection with the permissions you grant.

Limited License

LoadDebitCard.comR and its Third Party Partners reserve all rights in the Platform and you agree that this Agreement does not grant you any rights, ownership or licenses to the Platform except for the limited license set forth. Except as expressly authorized by LoadDebitCard.comR, you agree not to modify, reverse engineer, copy, frame, scrape, rent, lease, loan, sell, distribute, or create derivative works based on the Platform, in whole or in part. If you violate any portion of this Agreement, your permission to access and use the Platform may be terminated pursuant to this Agreement. "LoadDebitCard.com", "LoadDebitCard.comR", and all logos related to the Platform are either trademarks, or registered marks of LoadDebitCard.com. or Third Party Partners. You may not copy, imitate, or use them without LoadDebitCard.comR Compliance Team's prior written consent. All rights, title, and interest in and to the LoadDebitCard.com. website, any content therein, the Platform, and all technology and any content created or derived from any of the foregoing is the exclusive property of LoadDebitCard.com. and its Third Party Partners.
Unclaimed Property
If LoadDebitCard.comR is holding funds in a wallet on your behalf, and LoadDebitCard.comR is unable to contact you, and has no record of your use of the Platform for 30 days, applicable law may require LoadDebitCard.comR to report these funds as unclaimed property to the applicable jurisdiction. If this occurs, LoadDebitCard.comR will try to contact you via transaction memo line, email, or international mail service, at the address shown in our records, but if LoadDebitCard.comR is unable to locate you, it may be required to deliver any such funds to the applicable jurisdiction. LoadDebitCard.comR reserves the right to deduct a dormancy fee or other administrative charges from such unclaimed funds, as permitted by applicable law. Users have a maximum of 30 days to reclaim any assets that are held in the LoadDebitCard.comR system due to any error, whether by you or us. Refund requests submitted after the 30 day period will not be refunded. Any decisions by LoadDebitCard.comR with respect to refunds in these circumstances are final.
Legal Use of the Platform
We grant you access to use all of our products and Platform, but we still own the Intellectual Property associated with these products and Platform. If you haven’t logged into your LoadDebitCard.comR account for one year, and we are unable to get in touch with you, Seychelles law might require us to consider your account abandoned and we might then be required to transfer your account balance to the applicable jurisdiction.
Legal Compliance
The Platform is subject to Seychelles Commission Regulations, and by using the Platform, you represent that your actions are not in violation of such restrictions. Without limiting the foregoing, you may not use the Platform if
(i) you are a resident, national or agent of North Korea, Iran, Sudan, Syria or any other country to which the European Union embargoes goods (“Restricted Territories”),
(ii) you are on the Table of Denial Orders, the Entity List, or the List of Specially Designated Nationals (“Restricted Persons”), or
(iii) you intend to supply cryptocurrency or otherwise transact with any Restricted Territories or Restricted Persons.
Governing Law
We operate the Platform under laws of the Africa Union and specifically those of Seychelles, and these laws shall govern this User Agreement. Except for those disputes that shall be resolved in arbitration in the Country of Seychelles.
Entire Agreement
The failure of LoadDebitCard.comR to exercise or enforce any right or provision of the Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and remain enforceable between the parties, except as specified herein. The heading and explanatory text are for reference purposes only and in no way define, limit, construe, or describe the scope or extent of such section. This Agreement, including LoadDebitCard.comR policies governing the Platform referenced herein, the Privacy Policy, the Cookie Policy and constitutes the entire agreement between you and LoadDebitCard.com. with respect to the use of the Platform.
This Agreement is not intended and shall not be construed to create any rights, ownership or remedies in any parties other than you and LoadDebitCard.com. and other LoadDebitCard.com affiliates which each shall be a third party beneficiary of this Agreement, and no other person shall assert any rights as a third party beneficiary hereunder.
